《社会团体年度检查办法》公布，明确年检内容、程序、结论、处罚等要求

leaf="">按照《条例》相关规定并统筹年检的实效性，《办法》明确了年检工作的四个主要环节：一是1月31日前，登记管理机关发布年检公告或者通知；二是3月31日前，社会团体根据年检公告或者通知准备年度工作报告书及其他有关材料，报送业务主管单位进行初审；三是5月31日前，社会团体将经业务主管单位初审同意的年检材料报送登记管理机关；四是登记管理机关结合相关单位意见进行审查，原则上于9月30日前作出年检结论，并向社会公开。同时，基于工作实际，《办法》明确已脱钩和直接登记的社会团体于5月31日前直接向登记管理机关报送年检材料；并明确法律法规和国家政策对年检程序另有规定的，从其规定，以便制度衔接。</span></span></p><p leaf="">《办法》延续当前既定方式，规定社会团体年检结论包括合格、基本合格和不合格三种类别，并分别明确了三种结论适用的情形。同时规定，年检结论作出后，登记管理机关发现社会团体最近两个年检年度内存在有关违法情形且需要调整年检结论的，可以对相应年度年检结论进行调整并向社会公告。</span></span></p><p style="letter-spacing: leaf="">为加强年检结论运用、做好年检工作的后半篇文章，《办法》规定，登记管理机关在年检中发现社会团体存在问题需要整改的，应当要求社会团体进行整改；未按期完成整改的，由登记管理机关按照信用信息管理相关规定进行处理。同时，《办法》规定，登记管理机关可以结合工作实际将年检结论通报相关部门，并可以对不同年检结论的社会团体采取分类监管措施。</span></span></p><p leaf="">《办法》提炼总结年检工作多年实践经验，将《条例》第三十条第一款第（三）项“拒不接受或者不按规定接受监督检查”的情形与年检工作相结合，细化为年检材料隐瞒真实情况、弄虚作假，未按规定向登记管理机关报送年检材料以及其他拒不接受或者不按规定接受年检的三种情形，从而进一步明确了社会团体年检有关行政处罚的情形。</span></span></p><p bold;">八、工作衔接。</span>对于国际性社会团体和外国商会，《办法》规定其年检工作参照执行。对于登记或认定为慈善组织的社会团体，《办法》规定按照慈善组织有关管理规定执行。同时，考虑到全国东中西部情况有较大差距，《办法》规定，省级登记管理机关可以根据当地情况，制定本地区社会团体年检实施细则，为各地结合实际开展具体工作预留空间。</span></span></p><p leaf="">审查标准直接决定了社会团体的年检结论，也是最基本的年检制度设计。《办法》立足登记管理职责，围绕社会团体履行登记手续、机构设置、业务活动、财务管理、人员管理等关键环节划定监管红线，设置了基本合格或者不合格的10种情形；在此基础上，明确社会团体存在年检材料隐瞒真实情况、弄虚作假，上年度未开展任何业务活动，违背非营利宗旨开展活动，开展活动危害国家安全等严重情形的，年检结论直接确定为“不合格”。同时明确，社会团体存在基本合格情形，但情节轻微且未造成不良社会影响的，或者在年检结论作出前及时改正的，年检结论可以确定为“合格”。</span></span></p><p leaf="">对社会团体实施年度检查，需要发挥部门合力并强化结果运用。《办法》在年检审查方面，规定登记管理机关可以征求相关部门的意见；在年检结论运用方面，明确登记管理机关可以结合工作实际将年检结论通报相关部门；在工作衔接方面，要求登记管理机关在年检中发现存在涉嫌违反其他法律法规和国家政策情形的，依法将问题线索移交有关部门。通过上述规定，构建年检工作中党建工作机构、业务主管单位、行业管理部门等相关部门和登记管理机关各司其职、协调配合、分级负责、依法监管的综合监管体制，促进社会团体规范化建设与高质量发展。<span
